    iMEGA Responds to Attempted UIGEA Case Dismissal

    The Interactive Media Entertainment & Gaming Association (iMEGA) has responded to US authorities’ attempted dismissal of its court hearing against the implementation of 2006’s Unlawful Internet Gambling Enforcement Act (UIGEA).

    The US authorities motion, scheduled for September 26th 2007 in a New Jersey federal court, cites 'Lack of jurisdiction' and 'failure to state a claim upon which relief can be granted' as reasons why the case should be abandoned.

    iMEGA’s 50 page ‘brief’, i.e. response, to the motion answers several points of attack from US Justice authorities. In particular it challenges the US claim that the case remains 'unripe,' as the UIGEA has not as yet been given a legal framework, by arguing that US government has made the case 'ripe' by failing to adhere to the 270-day deadline for the deliverance of UIGEA regulations.

    In addition the IMEGA brief contests the fact that it has a lack of legal standing by stating that it is supported by prior legal precedent and that the that the UIGEA 'directly causes injury-in-fact to plaintiff's members and the public.'

    The US government has until September 21st to respond to the brief.
